Hy-Miler robber sent back to prison

A man who had been granted early release from prison is heading back.Caleb M. Hale, 23, who reports being homeless, had his judicial release revoked Monday by Huron County Common Pleas Judge Jim Conway. He then sentenced Hale to four years in prison for violating his probation.Hale only had been out on parole since mid-July when Conway granted him early release. The judge ordered him to complete a four- to six-month term in a community-based corrections facility (CBCF) and pay about $1,106 in restitution during his three years of probation. The restitution covers the cost of replacing a cash drawer and the $500 he stole. A CBCF is a form of prison which focuses on substance abuse treatment and education.The defendant's underlying conviction is robbery. Hale was sentenced to a four-year prison term July 28, 2015.The Willard Hy-Miler was robbed at gunpoint at 4:21 a.m. April 30, 2015.Hale entered the store wearing a blue bandanna that partially obscured his face and a black, hooded sweatshirt. Prosecutors have said he brandished an Airsoft gun, threatened to shoot the clerk if she called police and demanded money and some Newport cigarettes.The victim identified Hale by his voice and the part of his face she could see. Hale, in 2015, told the court he didn't plan to hurt the clerk with the Airsoft gun; he just wanted to scare her.In another case, Eric J. Smith, 42, formerly of 93 Milan Ave., was sentenced Wednesday to 30 months in prison for burglary. During a July 23 hearing, prosecutors agreed to dismiss one count each of theft, obstructing official business and falsification as part of a plea deal.And in other hearings:• Charles L. Alt Jr., 38, most recently of 49 Fruen St., pleaded guilty Monday to theft in exchange for the dismissal of one count of receiving stolen property. He will be sentenced Oct. 31. Alt has been unable to post a $5,000 bond since being arrested July 23.• Austin Burton, 19, most recently of 414 S. Myrtle Ave., Willard, pleaded guilty Tuesday to one count each of robbery and theft in exchange for the dismissal of one charge each of robbery, carrying a concealed weapon and resisting arrest. The defendant, who is out on a $15,000 bond, will be sentenced Nov. 1.• Della S. Cunningham, 51, most recently of 99 Linwood Ave., pleaded guilty Monday to aggravated possession of methamphetamine and will be sentenced Oct. 31. She has been in the Huron County Jail since Aug. 28.• Pamela J. Derby, 62, most recently of 3 S. Garfield St., pleaded guilty Tuesday to one count each of permitting drug abuse and illegal assembly or possession of chemicals for the manufacture of drugs. As part of a plea deal, prosecutors dismissed one count of illegal manufacture of drugs. Derby, who earlier posted a $10,000 bond, will be sentenced Oct. 31.• Carlos Haynes Jr., 21, of Cleveland, was sentenced Wednesday to 90 days in jail for an undisclosed probation violation. The judge also unsuccessfully terminated him from community control. Haynes' underlying conviction is forgery.• Shaun M. Lykins, 33, most recently of 23 E. Main St., Apt. B, New London, was fined $250 Wednesday for attempted aggravated trafficking in drugs. He also must pay $100 in restitution to the Norwalk Police Department. Also as part of his three years of probation, Lykins has a 90-day discretionary jail sentence hanging over his head. His probation officer has the option of when to impose part or all of the time without a hearing. • Wesley D. Miller, 40, of Barberton, was sentenced Wednesday to 90 days in jail for an undisclosed probation violation. Conway also unsuccessfully terminated him from community control. Miller's underlying conviction is attempted failure to register as a sex offender.• Cody J.M. Sydes, 25, most recently of 1224 Peru Olena Road, was convicted Wednesday of possession of hydrocodone for violating the unspecified conditions of his treatment in lieu of conviction.
