Food truck rules get last-minute changes

FINDLAY — Findlay's new rules on food truck operations were approved by council on Tuesday, with some last-minute changes. The vote was 8-1, with Councilman Jim Niemeyer, R-6, opposed. Councilman Jeff Wobser, R-at-large, was absent. The replacement legislation was introduced to council on Tuesday and added to council's agenda. Service-Safety Director Rob Martin said the changes were made after recent talks with food truck operators and other stakeholders. On Tuesday, Martin said the changes primarily focused on distinguishing between food truck operations on public versus private property. Changes made Tuesday will require food truck owners to be licensed and permitted to operate on public property. Food trucks operating on private property still need to be licensed and have the property owner's permission, but would not be required to get a city permit. The "special event" permits will be approved by the mayor's office. "I feel that this ordinance, the way it's been revised and as amended now, accomplished what we set out to do," Martin said. "We actually have a new industry that's growing and we didn't have ordinances or legislation that was able to fit with what they were doing." Martin said the process is now structured, easily followed and aligned with the rules in other communities. "Now, we have a punch list we can follow and it keeps our community safe. It keeps people accountable that work here every day, as well as the people that come in on the weekends or special events," said Martin. "So, I'm happy with this, but we can adjust as we need to." Food truck licensing will require a food service permit from the local health department, an inspection report from the Findlay Fire Department and proof of a propane tank leak test. Food truck drivers will also be required to furnish proof of a minimum of $1 million in liability insurance. The new rules also require the food trucks to display a licensing sticker on the truck near where orders are taken. The licensing fee is $100. Unhoused camps banned In other business Tuesday, council also voted 9-0 to approve "unhoused camps and public sleeping" legislation that bans sleeping on the sidewalks, streets, alleyways or at an entrance to public or private property. Any person found sleeping in these areas may be immediately removed. Campsites on sidewalks, streets, allies, any public right of way, park, public property, or under any bridge or viaduct are also prohibited, unless by a formal emergency declaration by the service-safety director. Violating the new ordinance would be considered a minor misdemeanor and carry of fine of up to $25. Repeat offenses would be considered a misdemeanor of the fourth degree. Both new ordinances will be effective almost immediately. Both pieces of legislation include "emergency language." Emergency legislation takes effect upon the mayor's signature, bypassing a 30-day waiting period meant to allow for public review and the possibility of a citizens' referendum.
