Kellogg to Findlay firm: L'Eggo my slogan

FINDLAY — A Findlay-based food truck, which calls itself "L'Eggo My Eggroll," is being sued by Kellogg Co., which claims trademark infringement of its "L'Eggo My Eggo" advertising slogan. The complaint, filed this month in U.S. District Court, in Toledo, seeks an order banning the food truck from using "L'Eggo My Eggroll" or anything similar to Eggo trademarks. It demands a jury trial and that the food truck pay to Kellogg "all gains, profits and advantages derived from" the alleged trademark infringement. In addition, Kellogg seeks money from the food truck business for Kellogg to undertake "corrective advertising" for alleged dilution of Eggo trademarks. Kellogg has been using the "L'Eggo My Eggo" advertising slogan since 1972. Kellogg seeks further damages based on the food truck operators' "willful and intentional conduct." L'Eggo My Eggroll's owners have ignored Kellogg's numerous letters and multiple oral communications since April 2024 requesting they cease using the name, Kellogg alleges. In fact, L'Eggo My Eggroll's owners responded with their own threats and demands for Kellogg to buy the food truck business for a "substantial sum," Kellogg claims "Defendant also communicated that Kellogg is responsible for medical bills related to the alleged reaction of one of Defendant's principals to Kellogg's letter," Kellogg claims in its complaint. A co-owner of "L'Eggo My Eggroll," Bobby Singkham, declined to comment Monday for this story. Besides the wordplay simulating the Kellogg product, Kellogg cited the food truck's "overall look and feel of the packaging for the Eggo products," including a red, white and yellow color scheme and "distinctive cursive font." "'L'Eggo My Eggroll' is nearly identical to the Eggo Trademarks and is highly likely to confuse consumers into believing there is some association between Defendant and Kellogg, when there is none," Kellogg stated.
