Charges against Upper Sandusky man dismissed

UPPER SANDUSKY — Criminal charges against Scott Dickey, 51, of Upper Sandusky, have been dismissed without prejudice. Dickey was first arrested in August 2024 and charged with gross sexual imposition, rape and two counts of abduction after a victim alleged he had sexually assaulted her while she provided him with massage therapy services. After a second victim came forward in late 2024 accusing Dickey of assault while in a vehicle with him, Dickey was also charged with assault and a second count of gross sexual imposition. In October of this year, a Wyandot County Common Pleas Judge Douglas Rowland presided as a Wyandot County jury found Dickey not guilty of rape after several hours of deliberation, but was unable to come to an agreement on the remaining five charges. After a meeting of counsel, a motion was filed to dismiss the remaining charges. The motion was granted by Rowland. Court documents say the decision was made in part because of the deadlocked jury. "After significant deliberation and additional instructions from the court, the jury remained deadlocked and was ultimately discharged with a mistrial ordered," the document read. "The court found the results of deliberations for those counts being a "hung jury" with no probability of agreement." The document later goes on to say that in making a decision as to whether or not to retry the case with a new jury, the state must consider factors such as the effect on the victims, the evidence presented at trial and juror opinions. Wyandot County Prosecutor Eric Figlewicz told The Courier in a phone call Friday that after discussion with those involved in the case, including assistant counsel, Kaitlyn Wilkin, assistant Ohio attorney general, that the case would not be sent back to trial. "After some very careful and considerate consideration that included a lot of conversations with law enforcement, victims, jurors who deliberated the case, ultimately we decided at that point in time that the case would not be retried," Figlewicz said. He would not comment as to whether the victims had the option to take this matter before a civil court.
