Kellogg in talks to settle over trademark dispute

TOLEDO — A trademark dispute between Kellogg Co. and Findlay-based food truck L'Eggo My Eggroll may be resolved outside the courtroom, according to a recent federal filing. Kellogg sued the small business in June 2025 in a U.S District Court in Toledo, alleging the truck's name infringes on the company's long-running "L'Eggo My Eggo" slogan. The breakfast food maker says the phrase has been in continuous use since 1972 and was trademarked that same year. The complaint seeks a jury trial and demands that L'Eggo My Eggroll turn over "all gains, profits and advantages derived from the alleged infringement. Kellogg is also asking for funds to conduct "corrective advertising" to address what it calls "dilution" of its Eggo brand, along with additional damages for what it describes as the food truck operator's "willful and intentional conduct." Court documents state that Kellogg sent multiple letters and made oral requests beginning in April 2024, urging the owners to stop using the name. Instead, the filing alleges, the food truck owners responded with threats and demands of their own. A new filing submitted earlier this month indicates the case may not reach a jury. Attorneys for both sides told the court they are "engaged in discussions aimed at resolving this matter in its entirety," prompting the judge to order a stay and pause all proceedings to allow negotiations to continue. A hearing scheduled for last week was cancelled. The parties have until April 6 to reach an agreement; if they fail to do so, a jury trial is tentatively set for this summer.
